LB 1032 adds tribal customary adoption to Nebraska child-welfare permanency options for Indian children. Where the statute’s conditions are met, a state court grants temporary concurrent jurisdiction to the child’s tribal court to finalize a tribal customary adoption under tribal custom, traditions and law. The act sets procedures for transfer back and state recognition, including conditions for full faith and credit. Tribal customary adoption may be accomplished without terminating parental rights; its detailed notice, timing and best-interests requirements matter.
